By installing or using Eureka3X you agree to these terms. If you don't agree, do not install or use the software. These terms form a binding contract between you and Roboris S.r.l.

Acceptance of Terms

This Agreement governs installation and use of the Eureka3X software, including the Free 3x version, the 3x Basic version, and the 3x Pro subscription version ('Software'). By installing, accessing, or using the Software, you agree to be bound by this Agreement. If you do not agree, do not install or use the Software.

License Grant

Roboris S.r.l. grants you a personal, non-exclusive, non-transferable license to install and use the Software on devices under your control, provided it is actively used by only one authorized user at a time. Access to 3x Pro and 3x Basic features, including updates, portal downloads, and Machine Configurations, is provided only during an active subscription term. The Free 3x version remains available subject to feature limitations defined by Roboris. You may evaluate the 3x Pro version by activating a 30-day trial, which requires no credit card upfront. At the conclusion of the trial period, continued use of Pro features requires an active subscription.

Authorized Distribution

The Software, including Free 3x, 3x Basic, 3x Pro, and all related Machine Configurations, may not be sold, sublicensed, leased, redistributed, bundled with paid services, or otherwise commercially transferred without prior written authorization from Roboris S.r.l. Authorized resellers and partners operating under written agreement with Roboris are exempt. Machine Configurations contain proprietary kinematic representations and technical modeling and are considered confidential technical material and trade secrets of Roboris. Machine Configurations may not be copied, shared, transferred, sold, distributed, published, or otherwise provided outside the licensed organization without prior written authorization from Roboris S.r.l.

Subscription and Billing
Basic & Pro Plans: 3x Basic and 3x Pro are provided as subscription services and renew automatically unless cancelled prior to renewal. Subscriptions can be purchased directly online via Paddle.com Market Limited (acting as Merchant of Record) or through an authorized distributor by requesting a custom quote. Access to subscription features ends immediately upon expiration or termination of the subscription.

Refunds and Cancellations

1. Online Purchases via Paddle: If you purchased your subscription online through Paddle, all payments are processed by Paddle.com Market Limited, acting as the Merchant of Record, and your purchase is subject to Paddle's Buyer Terms (https://www.paddle.com/legal/buyer-terms). Because the Software is digital content provided immediately upon purchase, all sales are final and non-refundable, except where statutory withdrawal rights apply under applicable law (such as the EU/UK 14-day withdrawal right, provided it has not been waived by accessing the content) or as expressly permitted at Paddle's sole discretion.


2. Purchases via Custom Quote or Reseller: If you purchased your subscription directly from Roboris S.r.l. via a custom quote (e.g., paid via Stripe) or through an authorized distributor/reseller, the transaction is governed by the specific terms provided on your quote, invoice, or reseller agreement. Generally, for business-to-business (B2B) transactions and custom orders, all sales are final and non-refundable unless explicitly stated otherwise in your specific agreement.


Cancellations: Subscriptions may be cancelled at any time to prevent future renewals, but cancellation does not provide a pro-rated refund for the current billing period unless required by applicable law.

Export Compliance

You agree to comply with all applicable export control laws and sanctions regulations of the European Union, Italy, the United States, and other relevant jurisdictions. The Software may not be used in connection with nuclear, missile, chemical, biological weapons development, or by sanctioned entities.

Machine Configurations

Machine Configurations are generic templates and not certified machine parameters. Customers are responsible for validating machine limits, axis behavior, tooling, fixtures, offsets, and safe operation prior to production use.

No Reverse Engineering

You may not analyze, derive, extract, reconstruct, or otherwise attempt to determine the structure, motion logic, axis relationships, kinematic transformations, or internal modeling methods of any Machine Configuration supplied with the Software. Machine Configurations may not be used to develop competing simulation models, digital twins, post-processors, machine definitions, or to reproduce, emulate, or derive machine definitions for competing commercial software products without written authorization from Roboris.

Security & Telemetry

The Software may include mechanisms to verify license compliance and improve functionality. Use of the Software is subject to the Roboris Privacy Policy available at https://www.eureka3x.com/privacy.

Acceptable Use

You may not reverse engineer, decompile, modify, bypass licensing controls, create derivative works, or use the Software in violation of applicable laws. Unauthorized redistribution or sharing of Machine Configurations constitutes a material breach of this Agreement.

Industrial Use
⚠️ Important: Eureka3X is a simulation tool and does not guarantee the accuracy of toolpaths, NC programs, collision detection, machining times, machine behavior, or simulation results. Users must independently verify all outputs prior to machining and are solely responsible for validating machine motion, tooling, fixtures, offsets, workholding, and machining operations. The Software does not replace a qualified CNC operator or manufacturing engineer. Roboris is not responsible for machine damage, tooling damage, injury, downtime, lost production, scrap parts, business interruption, or other losses arising from use of the Software or its outputs, even if a simulation, machine configuration, or software-generated result is inaccurate.

Intellectual Property

The Software, Machine Configurations, documentation, and related materials remain the exclusive property of Roboris S.r.l. This Agreement grants a license, not ownership rights.

Feedback

Any feedback, suggestions, or improvement ideas provided may be used by Roboris without restriction or compensation.

Warranty Disclaimer

The Software is provided 'AS IS' without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or accuracy of simulation results.

Limitation of Liability

To the maximum extent permitted by law, Roboris shall not be liable for machine damage, tooling damage, lost production, indirect damages, consequential damages, or business interruption. Total liability is limited to fees paid for 3x Pro during the previous 12 months. No liability applies to Free 3x users except where required by law.

Indemnification

You agree to indemnify and hold harmless Roboris from claims arising from misuse of the Software, violation of export laws, unauthorized redistribution, or breach of this Agreement.

Termination

Roboris may terminate this Agreement for breach, non-payment, export violations, or unauthorized distribution. Upon termination, access to 3x Pro ends immediately.

Support and Services

Support services may be provided under separate agreements or subscription plans and are not guaranteed for Free 3x users.

Amendments

Roboris may update this Agreement from time to time. Continued use of the Software after updates constitutes acceptance of revised terms.

Governing Law

This Agreement is governed by the laws of Italy. Business users agree to the exclusive jurisdiction of the Court of Pisa, Italy. Consumers resident in the EU, United States, or other jurisdictions with mandatory consumer forum rights may bring claims in their local courts where applicable law allows.

Entire Agreement

This Agreement constitutes the complete agreement governing use of Eureka3X and supersedes prior agreements relating to the Software.
